TERMS AND CONDITIONS

RATES INCLUDE
• Unlimited kilometres and basic insurance
• Goods & Services Tax (12.5%)
• A.A. 24 hour Roadside Assistance.
• A.A. Motor/Lodges Guides
• Rates are Negotiable for longer-term hires.

EXTRA DRIVERS
First driver free, extra drivers are $1 per day each

INSURANCE
a) Subject to the exclusions of that set out below, the hirer and any other driver authorised to drive the vehicle is fully indemnified in respect of any liability that he/she may have to the owner in respect of loss of or damage to the vehicle and its accessories and spare parts and any consequential loss of revenue or other expenses of the owner, including towing and salvage costs associated with the recovery of the vehicle and its accessories and spare parts.
b) Subject to the exclusions set out below, the hirer and any driver authorised to drive the vehicle is indemnified up to a limit of NZ$2,000,000.00; this is in respect of any liability he or she might have for damage to any property (including injury to any animal) belonging to any other person and arising out of use of the vehicles.
c) Third Party insurance is included in the quoted rate. The third party insurance covers you for all damage to a third party vehicle in the unlikely event of an accident. (Note: Options 1 & 2 do not cover window and tyre damage; Option 3 covers all damage including windows and tyres)

INSURANCE OPTIONS FOR DRIVERS 18-20 YEARS
You are required to take one of the following insurance options:
• Option 1: Insurance excess NZ$2,000.00 (1 April 2006 - 31 March 2007)
• Option 2: Insurance excess NZ$1,000.00, Pay an additional NZ$15.00 per day
• Option 3: Insurance excess NZ$100.00, Pay an additional NZ$20.00 per day
• Additional Tyre/Windscreen Waiver: Pay an additional NZ$4.00 per day

INSURANCE OPTIONS FOR DRIVERS 21 YEARS & OVER
You are required to take one of the following insurance options:
• Option 1: Insurance excess NZ$1,000.00 (1 April 2006 - 31 March 2007)
• Option 2: Insurance excess NZ$100.00, Pay an additional NZ$8.00 per day
• Option 3: Insurance excess nil, Pay an additional NZ$12.00 per day
• Additional Tyre/Windscreen Waiver: Pay an additional NZ$4.00 per day

JUCY STRONGLY RECOMMENDS THAT ALL CUSTOMERS TAKE THE EXCESS REDUCTION OPTIONS TO MINIMISE EXCESS EXPOSURE AND TRAVEL WITH PEACE OF MIND.

EXCLUSIONS
Excess options do not cover water submersion or salt-water damage, damage or loss of lights, tyres (unless hirer has taken Option 3 or Additional Tyre/Windscreen Waiver), roof, underbody and vehicle interior, and any damage caused from the use of snow chains and roof rack systems. Excess options also do not cover the cost to replace keys which have been lost or the
cost of retrieval of keys which have been locked inside a vehicle. All excess options are void if the terms of the rental agreement are breached.

INSURANCE EXCLUSIONS
a) Water submersion or salt-water damage is not covered by any insurance option.
b) Personal belongings are not covered. We recommend the hirer does not leave valuables in the vehicle and should take out personal insurance.
c) All Excess Reduction is void if the terms of the Rental Agreement are breached. The hirer will be responsible for the total cost of any damage. This will also include any damage caused by wilful conduct (e.g sitting or standing on the bonnet or roof of the vehicle) and driving under the influence of alcohol or drugs.
d) The vehicle is wilfully or recklessly damaged by the hirer or any other person named in the Schedule to this agreement or driving the vehicle under the authorisation of the hirer, or is lost as the result of wilful or reckless behaviour of the hirer or any such person. (Note: Punctures, damage to tyres, rims, burning out a clutch and any damage arising from using the vehicle to
propel any other vehicle are regarded as wilful or reckless damage).
e) None of the insurance options cover the incorrect use of fuel (fuel being diesel or petrol). The hirer will be responsible for any associated costs.
f) The hirer will be responsible for the cost to retrieve or recover a vehicle, which has become bogged, regardless of the insurance options taken.
g) If the vehicle is operated in any race, speed test, rally or contest; insurance is void.
h) The hirer is not a body corporate or department of State and the vehicle is driven by any person not named in the Schedule to this agreement.
i) The vehicle is driven by any person who at the time when he/she drives the vehicle is disqualified from holding or has never held a driver’s licence appropriate for that vehicle.
j) The vehicle is operated on any of the following roads: Ninety Mile Beach (Northland), Roads North of Colville Township, Ball Hutt Road (Mt Cook), Skippers Road (Queenstown).
k) The vehicle is operated outside of the hire or any agreed extension of that term.
l) It is agreed between the owner and the hirer that section 11 of the Insurance Law Reform Act 1977 shall apply with respect to the above exclusions as if this clause constitutes a contract of insurance.
m) The hirer acknowledges that he/she shall be liable in respect of the first of the damage or loss referred to in the insurance cover specified in this clause to the amount of the excess shown in the Schedule. This applies to damage or loss resulting from the theft or conversion or attempted theft or conversion of the vehicle.

BOND
a) A bond is required for all hires. You will be asked to sign a separate security bond in the form of a credit card imprint. This bond is held by the owner and is NOT banked; it is our guarantee that the hirer will return the vehicle on time and in the condition that it was hired in.
b) The owner reserves the right to bank the bond excess for a period of up to 3 months after the termination of the hire agreement to cover the cost of un-notified parking or speeding infringements or damage to third parties or their property.
c) Where the third party causes damage, the hirer is liable for damages as specified in their rental agreement. As insurance is not compulsory in New Zealand there is no guarantee that these damages will be recovered, therefore the bond may be banked and not refunded.
d) Where the car has been returned during or outside office hours and the vehicle has undiscovered damage to the windscreen or body of the car not covered by insurance, the client will be charged and sent a letter summarizing the cost of repairs.
e) A bond shall be taken for each accident. In the event of a replacement vehicle being dispatched, the bond will be twice that of the original vehicle.

PAYMENT
Full payment is required prior to dispatch off vehicle. Please note that an additional surcharge of 2% applies if payment is being made on Amex or Diners credit cards.

RENTAL DURATION
24 hours on time of pick-up. There is a 1 hour grace period, if the car is over 1 hour late a full day is charged. Payment is to be made at the commencement of the hire by either cash/ traveler's cheques or credit card.

TAX
Goods and Services Tax (G.S.T) of 12.5% is included in all daily hire prices.

EARLY RETURNS
There are no refunds for early returns. Returning a hired vehicle early may incur a penalty equivalent to 1 days hire. The daily rate on any discounted or special hires may be recalculated at rack rates.

ONE-WAY RENTALS
Available between all branches, minimum hire days apply. Repositioning fees may apply. Please note that for hires from Auckland Airport Branch to Auckland City Branch a NZ$30.00 one way fee may apply

CHILD AND BABY SEATS
Child seats are now compulsory on New Zealand roads (for children under 5 years of age). These may be hired from our offices. These need to be ordered at the time of reservation stating the age and weight of the child so the correct size will be booked.

DAYS OF OPERATION
Please note that Jucy Rentals Auckland, Auckland Airport, Christchurch and Queenstown are all closed on Christmas Day. Pick up and drop offs on this day are not possible. In addition to this the Queenstown office is closed on the 26th of December, 1st and 2nd of January.


AFTER HOURS PICK UPS AND DROP OFFS
After hours pick up and drop offs can be arranged through our reservations team. For all after hours pick up and drop offs there is a $30.00 administration fee that applies. Please note that after hours pick ups and drop offs cannot be done from our Queenstown branch.


AGE RESTRICTIONS
Drivers must be 18 years of age. A medical certificate is required for driver over the age of 75.

INFRINGEMENTS
We reserve the right to charge the hirer for any speeding or parking fines, associated administration costs and / or accidents incurring third party property damage reported on return of the vehicle.

ADDITIONAL HIRE ITEMS
These items need to be booked at the time of reservation.

New Born Car Seat $35.00 per rental
Toddler Car Seat $35.00 per rental
Booster Seat $35.00 per rental
Snow Chains $25.00 per rental
Ski Racks $25.00 per rental


EXCHANGE RATE / CURRENCY VARIATIONS
All credit card transactions are conducted in New Zealand dollars. Due to exchange rate fluctuations there could be some variance in the amount refunded compared to the amount initially charged. JUCY does not accept any liability for variances up or down.

CREDIT CARDS
When a credit card is presented as payment, the credit card holder will be jointly and severally liable as a customer. A credit card is needed for all hires. Preferred credit cards are Visa Card and MasterCard.

CHANGE OF DROP OFF DESTINATION
If the hirer wishes to change the drop off destination after the rental has commenced, they must first obtain authorisation from the Reservations Centre in Auckland. Subject to the change being approved, an additional charge of up to NZ$500 may apply.

RENTAL EXTENSION
If the hirer wishes to extend the rental whilst on hire, they must first obtain authorisation from the Reservations Centre in Auckland. This is subject to availability. The extra cost of an extended rental must be paid by credit card over the telephone on confirmation of the rental extension.
Failure to obtain authorisation will result in a fee of NZ$150 in addition to the daily rate.

ROAD RESTRICTIONS
Cars can only be driven on sealed/bitumen or well-maintained roads. No vehicle shall be driven on Skippers Road (Queenstown), Ninety Mile Beach (Northland), Ball Hut Road (Mt. Cook), North of Colville Township (Coromandel Peninsula) and Tapu-Coroglen Road (Coromandel Peninsula).
JUCY reserves the right at its sole discretion to restrict vehicle movements in certain areas due to adverse road or weather conditions.


ON-ROAD ASSISTANCE
Any problems associated with the vehicle, including equipment failure, must be reported to JUCY as soon as possible, and within 24 hours in order to give JUCY the opportunity to rectify the problem during the rental. Failure to do so will compromise any claims for compensation. We do not accept liability for any claims submitted after this period.

REPAIRS
Repairs up to NZ$100 may be affected without authorisation and will be reimbursed. For amounts over NZ$100, Jucy will need to be informed in advance. Repairs will be approved provided the hirer was not directly responsible for the damage. Receipts must be submitted for any repair or the claim will not be paid.

CHANGE OF VEHICLE
Should the vehicle booked be unavailable through JUCY reserves the right to substitute an alternative vehicle without prior notification and at no extra cost. This shall not constitute a breach of contract and does not entitle the hirer to a refund.

VEHICLE CATEGORY
Vehicles cannot be requested by make or model, only by vehicle category.

VOLUNTARY DOWNGRADE
Should the hirer decide to take a smaller vehicle than booked they will not be entitled to any refund.

DISCRETION
JUCY reserves the right to refuse any rental at its discretion.

ANIMALS
No animals are permitted in our vehicles, excluding guide dogs.

PERSONAL AND COMPANY CHEQUES
Personal and Company cheques will not be accepted as payment for rentals at the time of pick-up. Personal or Company cheques are not acceptable as the vehicle security deposit.
